DEFINITIONS: In golf, a �birdie� is a score of one stroke better than �par� for any hole on the golf course. �Par� is the normal expected score of a golf professional on any given hole. 1. PROMOTION PERIOD: The Deutsche Bank Championship 2006 Guess the Birdies promotion (the �Promotion�), part of the Deutsche Bank Championship�s Birdies for Charity Program, begins on May 3, 2006, at 12:00 p.m. Eastern Time ("ET") and ends on August 31, 2006 at 5:00 p.m. ET (the "Promotion Period"). 2. ENTRANTS BOUND BY THESE OFFICIAL RULES: Your entry into the Promotion constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of "Sponsor" (defined in Section 19 below), which are final and binding. Winning the prize is contingent upon fulfilling all requirements set forth in these Official Rules. 3. ELIGIBILITY: The Promotion is open to persons who legally reside in the 50 United States and District of Columbia who are 18 years of age or older at the time of entry. Employees of IMG Worldwide, Inc. are not eligible to participate in the Promotion. The prize winners must be able to pay all taxes, fees and expenses associated with the prize receipt and/or use. HOW TO ENTER: Entrants need to (a) accurately complete all required sections of the entry form, (b) enter the number of birdies that you think will be shot during The Deutsche Bank Championship 2006 to be held at The Tournament Players Club of Boston, and (c) if entering online, make a pledge to contribute .01 or more to the Official Championship Charities for each birdie actually made during the 2006 Deutsche Bank Championship. The Promotion Sponsor is responsible for the functionality of the Promotion. Online. During the Promotion Period, go to www.dbchampionship.com. Fill out the online entry form completely, enter the number of birdies that you believe will be shot during The 2006 Deutsche Bank Championship, make a pledge (at least .01 per birdie) for each birdie made during the 2006 Deutsche Bank Championship, and then submit the form and you will automatically advance to the Promotion page and receive one entry. You may enter this Promotion as many times as you like provided you make a pledge each time and comply with all of these Official Rules. �No Purchase Necessary� Entry. During the Promotion Period, you must go in person to the Sponsor�s office at 300 Arnold Palmer Blvd., Norton, Massachusetts 02766 (from 11:00 a.m. to 4:00 p.m. Monday through Friday, excluding holidays). Fill out the print entry form completely, enter the number of birdies that you believe will be shot during The Deutsche Bank Championship 2006, and then submit the form. Limit of one �No Purchase Necessary� entry per person and per household. 5. RESTRICTIONS: All entries must be received during the Promotion Period. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including but not limited to sweepstakes entry services) will void all entries by that entrant. Proof of entry submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. Failure to comply with these Official Rules may result in an entrant's disqualification at the sole discretion of Sponsor. 6. ODDS OF WINNING: Your odds of winning depend on the number of eligible entries received during the Promotion Period that correctly guess the number of birdies shot during The Deutsche Bank Championship 2006. 7. CONTINGENCY: In the event one or more days of The Deutsche Bank Championship 2006 are cancelled due to rain or any other cause beyond the Championship�s control, the number of 370 will be added to the actual total number of birdies for each cancelled day. 8. PRIZES: Winners are solely responsible for all taxes, expenses and fees associated with prize receipt and/or use. No cash or other substitution, sale, auction, donation, assignment or transfer of the prize is permitted, except by Sponsor, who reserves the right to substitute prizes with another prize of comparable value that will become effective upon announcement. One Grand Prize: 2 Season Tickets for the Boston Red Sox 2007 Season home games (approx. value: $10,000). In the event of a tie only, consolation prize(s) will be awarded. Consolation Prize: 2 weekly Michelob Ultra Palmer Pavilion 19th Hole Booklets will be awarded to each person not selected in the drawing for the Grand Prize. PRIZE WINNER SELECTION: The Grand Prize. The entrant who correctly guesses (or the entrant who comes the closest to the exact number without going over) the number of birdies actually shot during The Deutsche Bank Championship 2006 will win the Grand Prize. If two or more entrants correctly guess the exact number of birdies, or if no entrant guesses the correct number of birdies but two or more entrants guess the closest number without going over, then the grand prize winner will be drawn at random from among such winning grand prize winning entries. If a drawing is used, the drawn name will win the Grand Prize and each other entrant in that drawing will receive the Consolation Prize. First Place Prize. The first place winner will be drawn at random from among the eligible entries excluding, however, the winner of the Grand Prize and any Consolation Prizes. The prize winners are subject to verification by Sponsor, whose decision is final, in accordance with the terms of Section 10 below. An entrant will not be declared a prize winner unless and until that entrant's eligibility and identity has been verified and entrant has been notified that verification is complete. 10. Verification of THE PRIZE WinnerS: The prize winners will be notified by email. If no email address is provided in the entry, the notice will be sent by U.S. mail. At the same time, Sponsor will send an affidavit and release. Except where prohibited, the prize winners must sign and return to Sponsor, within 3 days of the date notice is sent to the prize winners at the email address or postal address given to Sponsor, the affidavit of eligibility, and liability/publicity release in order to claim the prize. If a prize winner cannot be contacted, or fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, that prize winner forfeits the prize and an alternate winner will be drawn as outlined in Section 11 below. Sponsor will require proof that each prize winner is at least 18 years of age at the time of entry. 11. ALTERNATE WINNERS: An alternate winner will be drawn at random from among the remaining (if any) eligible grand prize or first place prize (as applicable) winning entries received (and repeated if necessary and then from the entrants with the next closest guess), until the prize(s) is awarded to an eligible winner. Each alternate winner must comply with the terms of these Official Rules. 12. PRIVACY; USE OF DATA COLLECTED: Sponsor will collect personal information from the Promotion entrants and website visitors, including children, limited to name and e-mail address, in accordance with its Privacy Policies, available at www.dbchampionship.com, click on "Privacy Policy" at the bottom of the home page. No website visitor is required to disclose more information than is reasonably necessary. Any collected information is for internal purposes only, and is not disclosed to third parties. Information may be used for marketing purposes and/or to provide you with information that Sponsor believes may be of interest to you. In order to receive such information, marketing and otherwise, it is necessary for you to establish an account with Sponsor. For account registration, Sponsor requires your name and e-mail address. Under Age 13 Privacy Rules: If you are under age 13, you may not enter the Promotion. If, for any reason, you become aware that your child (who is under age 13) did enter this Promotion, you (as the child�s parent) may ask to have any personal information concerning that child deleted. To do so, please contact Sponsor. 15. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Promotion if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize pursuant to these contest rules from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unethical or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor is not responsible for any lost/delayed/corrupted/ mangled mail or e-mail, unreadable or incomplete entries, or any printing or posting typographical errors. 16. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including but not limited to the malfunctioning or unavailability of any computer, cable, network, hardware, software, Internet service or website; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt, redemption or use of any prize. 17. DISPUTES: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded, other than the administration of the Promotion or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Commonwealth of Massachusetts court located closest to Norton, Massachusetts; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Massachusetts. 18. Vermont residents may exclude return postage. 19. SPONSOR: The Promotion is sponsored by The Deutsche Bank Championship with an address at 300 Arnold Palmer Blvd., Norton, Massachusetts 02766 ("Sponsor"). 20. PLEDGE PAYMENTS: Although this Promotion will be administered by the staff of Sponsor, all funds will be collected by charity representatives to whom you pledged your donations and will not be accepted by Sponsor. After the completion of the Championship, each online entrant will receive an email from a charity representative that will include information regarding both check and credit card payments. Further, in the event that The Deutsche Bank Championship 2006 is less than a 72-hole event, a $.01 pledge will be valued at $10.00 (with other pledges pro-rated accordingly).
